Judge Sonia Sotomayor is judged to be NOT qualified
Not qualified for the seat she holds even NOW. She should be removed from the court, not elevated to our highest court in the land.
First off, Pres. Obama made a promise to Planned Parenthood that he would appoint justices who have "the heart, the empathy, to recognize what it's like to be a teen age mom; the empathy to understand what it's like to be poor, or African-American, or gay, or disabled, or old." This is a key statement for us to understand, for it denies the blind or unbiased application of justice.
Days after the anouncement, indicating that it was pretty well known already, Sotomayor's own words revealled a bias in her heart. You know the infamous quote by now. It was not just a rare "bad choice" of words or as Pres. Obmama said, "I’m sure she would have restated it". Nope, it was repeatedly stated over and over by her. This reveals a judicial temperment that we do not need on any of our courts and questions anyones ability to judge impartially. Sotomayor's temperment has also been described by others as being "a terror on the bench," "overly aggressive-not very judicial," "behaves in an out of control manner...makes inappropriate outbursts," just to name a few.
God commands us to find wise men, with understanding and appoint them judges. They are to judge righteously without respect of persons character, status or race. Hearing the great with the small and without fear of any man (Deut 1:16-17). They are to do NO wrong in their judgements, respecting not the poor nor the person of the mighty. (Lev. 19:15)
The judges are to take two oaths of office:
First, he must swear or affirm that “I will administer justice without respect to persons, and do equal right to the poor and to the rich, and that I will faithfully and impartially discharge and perform all the duties incumbent upon me … under the Constitution and the laws of the United States. So help me God.”
Second he must swear or affirm that “I will support and defend the Constitution of the United States against all enemies, foreign and domestic; that I will bear true faith and allegiance to the same; that I take this obligation freely, without any mental reservation or purpose of evasion, and that I will faithfully discharge the duties of the office on which I am about to enter. So help me God.”
A judge is to be wise and understanding. Sotomayor states there is no universal wisdom. This is contrary to human nature. Universally there is common logic and a common law that appeals to all people, it is written in our hearts. God states it in Proverbs 1:20-23. This wisdom comes after one fears God and seeks wisdom through obediance to His word. But, if you reject God and His word, or despise wisdom and instruction, then one becomes a fool, (Prov 1:7). Summarizing this in Prov 16:33, "The fear of the Lord is the instruction of wisdom, and before honor is humility."
Sotomayor doesn't think that the poor or the minorities can get justice unless they are represented by judges who have "experienced" these things. So, you have to have experienced being poor and if your not black you can not judge a black person's plea before the court. This is racist and is contrary to universal wisdom. People came from all around to have Moses judge their cases. They came there because of his Godly "wisdom" not because of his "opinion". He judged impartially, he didn't decide based on experience. If it were simply opinion well then they would simply go to someone else and get another opinion until they got what "they" thought would be in their opinion justice. Moses spent his first 40 years with a silver spoon in his mouth and would not qualify as a justice in Sotomayor's mind.
Sotomayor decisions would differ depending upon sex, race, etc. In the Senate hearings she says one thing to get votes. Here is what she really believes, quoting her, “Whether born from experience or inherent physiological or cultural differences … our gender and national origins may and will make a difference in our judging.” If this is true, that the experiences are "important" to qualify a judge, then lets get to the details of Sotomayor. This is so important as to why a judge has to be impartial and Sotomayor is NOT.
Here is a great point....
"If so, then why should we believe Judge Sotomayor when she tells us that her “gender” and her “Latina heritage” are the two most prominent determinants that shape her judicial opinions. She is not just a woman, but she is a divorcee and childless. And she is not just a self-described “Latina,” but she is a “Newyorkrican,” that is a “born and bred New Yorker of Puerto-Rican born parents who came to the states during World War II.” And she is a diabetic, and has been since childhood, and was raised by a single mother and whose father died when she was young. If law is nothing more than a judge’s life’s experiences, then shouldn’t Judge Sotomayor open the entire book of her life, including her failed marriage, to Senate scrutiny? How else would a Senator know how to vote on her confirmation?" - Herb Titus
Sotomayor does not measure up to be a judge when we use God's word to help us to decide. Herb Titus lays all of the following out where Sotomayor FAILS to qualify to be able to judge righteously in our great land.
Sotomayor wrongfully believes:
“There can never be a universal definition of wise … I would hope that a wise Latina woman with the richness of her experiences would more often than not reach a better conclusion than a white male who hasn’t lived that life.”
Sotomayor wrongfully believes:
”’[T]o judge is an exercise of power’ and because there is no objective stance, but only a series of perspectives—no neutrality, no escape from choice in judging. I further accept that our experiences as women and people of color affect our decisions.”
Sotomayor wrongfully believes:
“Whether born from experience or inherent physiological or cultural differences … our gender and national origins may and will make a difference in our judging.”
Sotomayor wrongfully believes:
“The aspiration to impartiality is just that—it’s an aspiration because it denies the fact that we are by our experiences making different choices than others.”
Sotomayor wrongfully believes:
“We … must continue … to figure out how we go about creating the opportunity for there to be more women and people of color on the bench so we can finally have a statistically significant numbers to measure the difference we will and are making.”
In contrast to Sotomayor's embarassing and infamous quote. Former Supreme Court Justice Sandra Day O’Connor who often said that she did not view herself as a female jurist. Instead, she said that a wise old man and a wise old woman would reach the same result as judges.
Sotomayor should not be elevated to this lands highest court.
